DELIVERY POLICY

The products sold by SC SEEN Cosmetics SRL can be delivered throughout the European Union with the help of partnering courier companies.

Please enter the destination address when completing the order to display the delivery rate.

SC SEEN Cosmetics SRL will ship the products within the terms mentioned on the online store for the ordered product, within a range of 1-3 working days from the date the order was generated or within 10 days at most from the date the customer generated the order in special cases (promotions with a strong impact, Black Friday, unforeseen events, vacation period, etc.).

The shipment confirmation will contain information for tracking the order.

If the product is/is no longer available, the company will inform the customer about this unavailability, following that the sums of money paid by the customer for the unavailable product, if they exist, will be reimbursed within a maximum of 10 days.

If SC SEEN Cosmetics SRL receives erroneous information related to the delivery of the products, it can refuse to honor the delivery, without this being considered a breach of the contract, or it can set a new deadline for honoring the order.

Shipments cannot be delivered to PO boxes or zip codes. Shipments are delivered to the Recipient’s address communicated by the Sender, according to the rules of the partnering courier company in each country.

The courier company may notify the Recipient of a future delivery or a failed delivery. The recipient can be offered alternative delivery solutions such as next day delivery, delivery without receipt signature, redirection or collection from a dispatch center.

The Courier Partner will make all reasonable efforts to deliver items according to their normal delivery schedules, but these are not mandatory. SC SEEN Cosmetics SRL and the partnering courier company are not responsible for any damages or losses caused by delays. 

Modifying or canceling the order

We remind you that we cannot make changes to orders already placed. Please check the contents of the basket before placing the order and make sure that both the type and the number of products are correct.

If you want to cancel an order whose status is: “In Processing”, this can be done by contacting the Customer Relations Department by email at the address: hello@seenbeauty.ro

In the conditions that the customer did not inform the company about the wish to cancel the order, its refusal to receive the order is considered an abuse. Thus, we reserve the right not to honor the orders of customers who have previously refused an order, unless they pay the value of the order in advance.

Also, the customer will be charged the transport fee if the parcel is refused/not picked up, the recipient cannot be found, the parcel cannot be delivered as a result of incorrect/incomplete data. The customer will be returned only the amount related to the ordered product. We also reserve the right to withhold amounts equivalent to the extra fees charged to us due to any situations generated by the fault of the recipient.

Orders are delivered by courier from Monday to Friday, to the address mentioned in the order. Weekends and legal holidays are not considered working days. Considering that we use an outsourced service, we cannot ask the partnering courier company to deliver at a certain time or on a certain date. Also, we are not responsible for delays caused by the partnering courier company. The mentioned delivery term can be exceeded in certain cases such as promotional periods, holidays or periods when the roads are impassable (floods, massive snowfalls, etc.).

Please check the integrity of the outer packaging (box) and if it shows signs of damage, conclude a damaged delivery document with the representative of the courier company.

RETURN POLICY

In accordance with article 16 of the Romanian Gov. Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals, the right of withdrawal cannot be exercised for orders that refer to:

– the supply of goods that have been unsealed after delivery, which can no longer be returned for reasons of hygiene or health protection;

Therefore, the Buyer acknowledges the fact that he will not be able to avail himself of his legal right of withdrawal regarding the products unsealed by him, whose resell by Seen Beauty could present risks for reasons of hygiene or health protection for consumers (for example: skin/hair care products, make-up, etc.).

Thus, only products that comply with the form in which they were delivered, accompanied by the purchase invoice, are accepted for return. 

The following are not accepted for return:

Products that have been opened

Products that have been tested/used

Products that do not have the labels intact, have broken or erased seals

Products purchased from other stores

Products not accompanied by documents proving the purchase (invoice or tax receipt)

Products with packaging damaged in any way

These measures are specific to cosmetic products, as their validity period is calculated starting with the first opening of the package, and with their use/testing, there is the risk of transmitting bacteria by transferring the product to another person.

If the product meets the above conditions, contact the Customer Relations service at hello@seenbeauty.ro regarding the desire to return, and you will be contacted by an operator to indicate the next steps.

The products must be returned in the original packaging and be in exactly the same condition in which they were received by the customer. We reserve the right to refuse the return if the products have been checked and do not meet the return conditions. Round-trip fees in this case are the responsibility of the customer. If the return is resolved by refunding the value of the products, the refund will be made by bank transfer to the account indicated by you in the return request, within 10 days at most from the receipt of the products. The return fees are borne by the customer and paid in advance, except in cases where the product is damaged upon receipt or you receive a different product than the one you ordered, in these cases the shipping fee is borne by us.

We do not accept parcels with cash on delivery or whose sender cannot be identified. We are not responsible for lost or damaged parcels during transport. We do not pick up parcels from post offices.

If the customer declares a non-conformity of the purchased good, SC SEEN Cosmetics SRL agrees to comply with the legal provisions in force, including GEO 140/2021, through which the provisions of Directive (EU) 2019/771 of the Parliament were transposed into national legislation of the European Council of 20 May 2019 regarding certain aspects related to contracts for the sale of goods and established the legal framework regarding sales contracts concluded between the seller and the consumer, in particular rules regarding the conformity of goods, corrective measures in case of non-conformity, the modalities of implementing those corrective measures, as well as commercial guarantees in order to ensure a high level of consumer protection and the proper functioning of the internal market.

It is considered that the products comply with the concluded contract, if they:

• comply with the description, type, quantity and quality and possess the functionality and other characteristics provided for in the sales contract;

• they correspond to the special purpose for which the consumer requests them, which the consumer brought to the seller’s attention at the latest at the time of concluding the sales contract and which the seller accepted;

• correspond to the purposes for which goods of the same type would normally be used, taking into account, where appropriate, the legal provisions in force, technical standards or, in the absence of such technical standards, codes of conduct applicable in the field and specific to the sector;

• as the case may be, possess the quality and correspond to the description of a sample or model that the seller made available to the consumer before the conclusion of the contract;

• if applicable, are delivered together with accessories, including packaging, installation instructions or other instructions that the consumer can reasonably expect to receive;

• possess the qualities and other characteristics, including durability, functionality, compatibility and security, which are normal for goods of the same type and which the consumer can reasonably expect, having regard to the nature of the goods and taking into account any public declaration made by or on behalf of the seller or by other persons located in earlier stages of the chain of transactions, including by the manufacturer especially in advertisements or on the label.

If the lack of such attributes is found shortly after delivery, without exceeding 30 calendar days, the buyer/customer can opt for:

• bringing the product into compliance, by replacing the product with another identical product or with other products that have the same economic value as the returned product, at the time of purchase, provided that it/they are in stock, unless the corrective measure chosen would be impossible or, compared to the other available remedy, would impose costs on the seller that would be disproportionate;

• a price reduction proportional to the decrease in the value of the purchased goods compared to the value that the goods would have if they were in compliance;

• refund of the value of the product, within a maximum of 10 days from receipt of the return

The client/consumer who suspects a non-compliance of a purchased product in terms of composition, stability, microbiology, etc. or has doubts about its quality, can notify Seen Beauty at hello@seenbeauty.ro. They will complete a written statement, in which they will explain what the non-conformity of the product consists of, being able to request the return through an unequivocal statement in this regard.

After receiving the return from the consumer, the SEEN COSMETICS SRL company will inform the client about the costs related to the laboratory tests that must be borne by the client in advance at the time of the request, based on an invoice from the authorized person (chemist/laboratory). SEEN Cosmetics SRL will send the complaint together with the product, the packaging, the proof of purchase and the customer’s statement to the authorized laboratory for investigation.

At the same time, the consumer must know that the investigation procedure can last up to 4 months (with the possibility of being extended, depending on the complexity of the investigation). If the manufacturer concludes that the product has a non-compliant content, then the return is accepted, and under these conditions, the customer will be refunded the amount paid for testing.

If the content of the product is declared compliant, SEEN Cosmetics SRL reserves the right to refuse to replace the product or refund the money and the product is returned to the customer in the condition in which it was received after investigation. In this case, all additional expenses generated regarding the transport of the product back to the customer will be borne by him.
